Globalised recorded 22 successful E-3 visa outcomes for clients who attended interviews during September 2026. The month included 17 initial E-3 applications and five renewals, covering 18 separate employer arrangements across technology, finance, mining, infrastructure, creative production, manufacturing, consumer products and founder-led businesses.
The results reflect the range of work now carried out by Australian professionals and companies in the United States. Our clients included founders, chief executives, software and artificial-intelligence professionals, creative-production specialists, engineers, commercial leaders, finance and tax professionals, operations specialists and other experienced Australian employees.

The employers and industries represented
The 22 successful outcomes involved a broad cross-section of Australian and US businesses. The employers included established international companies, early-stage technology businesses, founder-led enterprises, professional-services firms and Australian companies building their first substantial US presence.
The industries included:
- Artificial intelligence and enterprise software.
- Financial technology, tax technology and payments automation.
- Mining services, engineering and infrastructure technology.
- Visual effects, creative production, media and entertainment.
- Building products and advanced manufacturing.
- Consumer products, health products and hospitality.
- A nonprofit and mission-driven organisation.
- New US ventures led by Australian founders and business owners.
Some employers were sponsoring an E-3 professional for the first time. Others had worked with Globalised on earlier applications and returned for a renewal or a coordinated team expansion. In each matter, we worked with the employer and applicant to define the US position, establish the wage and worksite arrangements, prepare the Labor Condition Application and present a consistent consular application.
The roles approved during September
The approved roles demonstrate the breadth of positions that can qualify for E-3 classification when their professional requirements are properly analysed and documented.
The month included:
- Founders, chief executives and company directors.
- Software engineering and technical roles.
- Artificial-intelligence and emerging-technology positions.
- Visual-effects, production and creative-operations roles.
- Marketing, commercial and business-development positions.
- Engineering, mining and infrastructure roles.
- Finance, tax and operational leadership positions.
A job title never resolves the specialty-occupation analysis by itself. We assessed the actual duties, the specialised knowledge required, the employer’s minimum qualification requirements and the applicant’s education or equivalent professional background. The support letters and interview preparation then explained the role in practical terms that were consistent with the LCA and the wider application record.
Founder, CEO and new-company approvals
September included several successful applications for founders, chief executives and company directors. These matters involved Australian entrepreneurs developing US operations and senior leaders taking responsibility for American growth.
Founder cases require focused work on two separate issues. The proposed position must qualify as a genuine specialty occupation, and the evidence must establish a credible employment relationship with the US entity. We addressed the applicants’ duties, qualifications, ownership, governance, reporting arrangements and the authority applying to their employment.
The successful founder and executive matters included newly formed US companies and businesses at an early stage of American growth. A new company does not need a long US trading history to support an E-3 application. The evidence should establish a genuine business, a genuine professional position and a credible ability to meet the employer’s wage obligations.
One September approval involved the Australian founder and CEO of a US-listed technology company. His role and remuneration spanned Australia and the United States. We defined the US assignment, documented the governance arrangements and structured the compensation so that the US employment independently satisfied the applicable prevailing-wage requirement.
Three coordinated visas for one Australian leadership team
One Australian visual-effects and 3D scanning business obtained three E-3 visas for its US expansion. The successful applicants were the company’s Chief Executive Officer, a Creative Operations Manager and a VFX Production Coordinator.
We developed the three applications as one coordinated commercial project while ensuring that each case independently satisfied the E-3 requirements. The work included three occupational classifications, three wage analyses, three LCAs and three separate qualifications cases.
The project also shows how the E-3 can support specialist creative and production businesses. We explained the professional knowledge behind the roles, including digital capture, LiDAR scanning, photogrammetry, VFX production, technical workflows and creative operations. All three visas were issued.
Urgent applications for technology businesses
Several September matters required rapid preparation because the employee’s US role or travel timetable was approaching. In one artificial-intelligence matter, the case was opened early in September and the successful interview occurred less than three weeks later.
An urgent E-3 case still requires a complete LCA process, a defensible role and qualifications analysis, accurate application forms, employer evidence and interview preparation. We progressed the available workstreams in parallel, identified the decisions needed from the employer and maintained one consistent record across the application.
We advise clients to begin earlier whenever possible. Appointment availability, LCA processing, employer responsiveness, passport return and administrative processing remain outside the applicant’s control. Where time is limited, early legal triage helps identify whether the proposed timetable is realistic and which materials should be prioritised.
Renewals and continuing US employment
Five of the successful September outcomes were E-3 renewals. Renewal applications require current evidence. A previous approval supports the history of the case, but the new application must reflect the present employer, duties, salary, worksite, qualifications and immigration record.
Our renewal work included reassessing the position, preparing a fresh LCA, updating the employer evidence, reviewing the applicant’s travel and status history and preparing the applicant for the new interview. The successful interviews took place in Sydney, Melbourne and Toronto.
The choice of consular post requires planning. We advise on the current country-of-nationality or residence guidance, appointment arrangements, travel timing and the practical consequences of remaining outside the United States while the passport is held for processing.
Applications involving prior immigration complications
The September results also included matters with adverse US immigration history.
One applicant had previously been refused entry while attempting to use ESTA for frequent business travel and had later received an unsuccessful visitor-visa outcome. We assessed the prior history, prepared the E-3 application and addressed the purpose and scope of the proposed US employment. The E-3 visa was issued.
Another applicant had previously pursued an extension through USCIS and encountered a request for further evidence. The in-country process was not completed, and the applicant later pursued a consular E-3 renewal. We reviewed the earlier filing, prepared the current application and addressed the record directly. The visa was issued.
Prior ESTA, visa, admission or USCIS issues should be reviewed before a new application is lodged. The legal effect depends on the actual decision, the relevant statutory provision and the applicant’s later conduct. A clear, accurate account supported by the appropriate records is more persuasive than avoiding a known issue or relying on an informal description of what occurred.
What Globalised handled
Our work across the September matters included:
- Assessing E-3 eligibility and the available visa strategy.
- Analysing the specialty occupation and applicant’s qualifications.
- Advising on founder, owner and governance arrangements.
- Determining the appropriate occupation, wage level and worksites.
- Preparing and lodging Labor Condition Applications.
- Preparing employer support letters and application evidence.
- Preparing DS-160 applications and reviewing the complete factual record.
- Advising employers on notice and Public Access File obligations.
- Coordinating dependent-family applications where required.
- Conducting one-to-one attorney interview preparation.
- Advising on prior refusals, ESTA issues and immigration history.
- Monitoring outcomes and assisting with passport return and post-approval steps.
The employer and applicant sides of an E-3 matter are closely connected. We manage both so that the role, wage, qualifications, employment terms and application answers remain consistent throughout the case.
What the September results demonstrate
The E-3 remains a highly effective route for Australian professionals and businesses when it is available. It can support a first US hire, the transfer of an experienced Australian employee, a founder establishing an American operation, a specialist joining a US technology company or a wider team expansion.
The month’s results also show that E-3 work extends well beyond conventional corporate positions. Creative-production specialists, artificial-intelligence professionals, technical employees, founders and senior commercial leaders can all qualify where the actual role meets the specialty-occupation standard and the applicant has the required qualifications.
Strong preparation matters most when the facts are unusual. Ownership, a new US company, experience-based qualifications, complex travel history, a prior refusal or an urgent timetable can all be addressed through early analysis and a disciplined application strategy.
