E-3 Visa Lawyers for Australians

E-3 visa legal services delivered from right here in Australia.

The E-3 visa is a United States non-immigrant visa category created only for Australian citizens working in “specialty occupations.”

The key requirements of the E-3 visa are that the principal employee applicant be an Australian citizen, have a valid job offer in the United States at a sufficient salary and professional role, and be in possession of a Bachelors degree or higher (or sufficient years of work experience in lieu).

Specialised E-3 experience and expertise

The E-3 visa differs from most other work visa categories in that it does not require a petition to be lodged with the immigration department (USCIS) in the United States. Instead, the US Consulates abroad assess the merits of the application at an in-person interview.

As such, with the visa eligibility being assessed on-the-spot in a time-crunched interview with documents presented by the visa applicant (employee) to the Consulate, special care is required with the E-3 visa process.

Being based in Australia, we have expertise and experience with the E-3 visa developed by supporting hundreds of E-3 visa applications at US Consulates in Australia and around the world.

We know what goes into a successful E-3 visa application, what Consuls want to see and what they don’t, as well as how to navigate complex processes and forms required for an E-3 visa application.

We provide a “full service” for our E-3 applications which differs from how most immigration law firms in the United States approach visa applications (which, as mentioned above, fundamentally differ as they are “petition-based”).

Our E-3 visa services: what’s included
  • Initial eligibility checks, advice, and strategy / planning with attorney
  • Streamlined document intake and questionnaire provision — endeavouring to make only a single request for documents and questionnaires seeking only the information actually required
  • Consulate interview booking and government fee payment on behalf of the visa applicant
  • Preparing the Labor Condition Application (LCA) application with the Department of Labor on behalf of the Employer
  • Provision of required compliance documents (posting notice, Public Access File) and advice to Employer
  • Drafting of the State Department Form DS-160 on behalf of all applicants
  • Provision of DS-160 submission instructions
  • Drafting of required documents
  • Advice to employee/visa applicants regarding eligibility and supporting documents required
  • Provision of all required documents in a single file
  • Pre-interview Zoom/Teams/phone meeting with Applicant(s) to review documents, advise on consular procedures, prepare for interview questions, and answer any questions
  • Post-interview follow-through: passport return tracking, confirmation of proper visa issuance, guidance regarding maintaining status and I-94 records once in the United States
Our difference

Being based in Australia, our US immigration attorney is available in the same time zone as applicants and Australian businesses navigating the E-3 visa maze. Australian clients transact with us with trust, knowing we are regulated members of the legal profession in Australia.

But further than that, we possess a specialised focus on the types of visas that are most relevant to Australians, and this focus is usually different to the focus of immigration attorneys based in the US. We understand Australian workplace culture and we know Australian employers want their employees to be looked after, especially through the stressful process relocating to another country. That’s why we engage with the full scope of the process and provide full support through every aspect of the E-3 visa process.
